Photographs/videos taken by Jamie Hollins and/or any other employee of Phlik'd Photography & Philm, LLC. while on duty and/or with Phlik'd Photography & Philm, LLC. owned equipment are the copyright and property of Phlik'd Photography & Philm, LLC. and Jamie Hollins, for the benefit of the Phlik'd Photography & Philm, LLC. portfolio, online use/references to Phlik'd Photography & Philm, LLC. photos, and Phlik'd Magazine. Photos will be credited to any client unless the photographer requests individual credit (e.g. Lisa Frank/2012).
Phlik'd Photography & Philm, LLC. photos are strictly available for editorial purposes (non-profit educational or research use or other non-commercial use by Photography & Philm, LLC. and other organizations as allowed by Jamie Hollins). Special contracts with professional photographers and/or model releases are required for any photo intended for commercial or pseudo-commercial use (i.e. social marketing, e.g. portrait of an individual on a condom package). In general, Phlik'd Photography & Philm, LLC. photos are subject to inclusion in photo-sharing applications or websites, where they may be downloaded and used by others across the Internet for non-profit, educational use promoting international health and development.
Photographers must respect their photo subjects and take in consideration whether photo subjects may experience negative consequences of having their photo taken and used. Phlik'd Photography & Philm, LLC. staff is expected to obtain verbal consent from all photo subjects. When possible obtaining written consent is the best practice, particularly when sensitive, personal, private information is revealed in the photo or corresponding caption. See attached Informed Consent Guide for tips on how to obtain informed consent. In general, in the United States, photographs of individuals may be taken if that individual is in a public place. Permission will be required for any commercial use, and may be required before disseminating any photograph where an individual is recognizable, unless the person’s presence in the photograph is purely incidental (e.g. a photograph of a building that includes pedestrians on a public sidewalk).
Phlik'd Photography & Phil, LLC owns all rights to all photos taken. Unless you sign a release form, please be advised that all material belongs to the company and are used for company use like magazines, web design, and/or any other purpose. When preparing presentations, reports, websites, brochures, CD-ROMs, or any other material that incorporates photos, staff is expected to use photos in a context that fairly represents the real situation, subject identity, and/or physical location of the image. Never alter the content or meaning of a photograph. In order to protect the identity of vulnerable populations at risk of reprisal, violence, or rejection in their communities as a result of telling their story, it may be appropriate to leave out detailed information about the content of the photo. Due regard must be given to the individual rights and privacy of photo subjects, basic tenets of human dignity must be observed.
People hired to take photos should receive clear, written instructions. At a minimum, terms should address: ownership of photographs; copyright; expected outputs (e.g. prints, negatives, digital files, backup copies, etc.); fees for service; and expected practices (e.g. verbal/written consent). For a full refund of accommodation fees, cancellations must be made a full 72 hours prior to scheduled time. For example, if the photo shoot is on Friday, cancel by Tuesday of that week before photo shoot time to receive a full refund. If you fail to cancel or reschedule your photo shoot after the 72 hour mark, Phlik'd Photography & Philm is entitled to keep the full amount of deposit/paid package.
